Cemetery Policies

Sunset Memorial Gardens of Jamestown, North Dakota

These policies help maintain the peaceful, park-like setting of Sunset Memorial Gardens while protecting the interests of all lot owners and families.

General Information/Rules:

  • Sunset Memorial Gardens of Jamestown is commonly referred to as “Sunset”.
  • All vehicles should (Keep Right) when entering cemetery grounds from the main east entrance from Highway 20 to help establish a uniform drive through the cemetery.
  • Under no circumstances are individuals allowed to drive onto the grounds without prior permission. Sunset staff and management will reserve the right to ingress and egress to allow for burial, maintenance, installations, and construction.
  • Pets and service animals are allowed on the cemetery grounds given they are leashed, and waste is immediately picked up. Visitors that do not adhere to this will be asked to leave. 
  • All Souls Prairie Chapel can be reserved by contacting the office. It is not open unless requested.
  • Sunset Memorial Gardens and All Souls Prairie Chapel are non-sectarian. Both are open to any religion, race, sexual orientation, etc.
  • Sunset management takes reasonable precautions to protect and uphold property. However, Sunset is not responsible for conditions out of our control such as extreme weather events, sustained periods of drought, animals, vandalism, theft, terrorism, etc. 
  • These rules and regulations may be changed or modified at any time it may require, without notice by the cemetery to lot owners. Please call our office with any questions.

Seasonal Decoration Guidelines:

To maintain the cemetery grounds throughout the year, seasonal decoration guidelines are observed:

October 1 – April 15

  • Holiday and winter wreaths are permitted and encouraged. Flower vases should remain lowered.

April 15

  • Spring cleanup begins (weather dependent).

Memorial Day Period

  • For 14 days before and 14 days after Memorial Day, decorations are allowed without restriction. Decorations should remain close to the grave marker.

June 15 – October 1

  • During peak mowing and trimming season, decorations must be placed inside flower vases only.

Grave Decorations Rules: 

  • Decorations that sit outside the vase and which are larger, are allowed for 14 days before and 14 days after Memorial Day. Please remove any decoration that is not kept inside a flower vase after this period. They will be removed if they are still in place.
  • Fall cleanup begins around Oct. 1st (weather dependent). During fall cleanup, we will discard any items that have not been picked up or that have not been set aside after notifying the office. Sunset will hold onto personalized decorations, but we do not have the room to store them for an indefinite amount of time, and they will be discarded the following Spring if families have not claimed them.
  • Fall cleanup requires us to put each flower vase down and install marker stakes to identify lot numbers, so winter burials are possible without damaging markers or vases. Any vase/decoration that is put back up after Fall cleanup and is damaged during normal working procedures is not subject to our replacement policy. We try our best to ensure there is no damage to any grave marker, vase, decoration, etc., but we please ask lot owners to help us in that endeavor.
  • Please note that high winds, rain, and extreme weather conditions can damage or displace grave decorations. Sunset cannot be responsible for those losses, and we encourage families to ensure each decoration is able to withstand those conditions.
  • No planting of any kind in any section of the cemetery is permitted.

Interment Rights/Burial Regulations:

  • Any interment or disinterment shall not occur if there is an outstanding financial obligation, unless otherwise agreed upon.
  • Each grave space or lot allows for one of these instances; one (1) traditional casket interment and one (1) cremation interment, or (2) cremation interments. 
  • A burial vault is required for both a traditional casket interment and a cremation interment. Burial vaults are available through Sunset.
  • The transfer/sale of interment rights must be done through cemetery management. An administrative fee may be charged for this transfer. The current owners of interment rights are responsible for informing the office of any updates or changes to their personal information. Ownership rights will follow the succession rules as provided in the North Dakota Century Code. Sunset may need additional documentation to establish ownership and is not responsible for any errors that may be committed due to lack of adequate information.
  • Sunset recommends lot owners outline, whether in a will or in writing to the cemetery, who shall receive any additional internment rights and thus be responsible for additional lots, and/or the care of spaces that have already been used.
  • Every deed issued to a lot owner at Sunset contains a provision that the lot owner takes title subject to the rules and regulations then in force, and which may be made in the future. These regulations are binding upon purchase as though they were incorporated in the deed.
  • No persons other than Sunset management and staff shall open/close a burial of any kind.
  • Scattering remains on cemetery property is not allowed.

 Cemetery Headstone/Marker Regulations:

  • Sunset currently only allows bronze memorials on granite or similar products. We do not allow concrete bases. Bronze Memorials allow for ease of maintenance and to create a park-like setting that is easy to maintain for generations to come.
  • Bronze memorials can be ordered directly through Sunset as it allows us to continue to properly care for and plan for future developments in the cemetery.
  • Grave marker installation is only to be done by cemetery staff or by contractors with permission.
  • Any memorial not purchased through Sunset requires notification by contacting the office.
  • Resetting or leveling a marker can be requested by contacting the office. Please allow for time for this request to be fulfilled.
